Article 1 Definitions


"Applicable Law" means any national or international Law in force from time to time in the territory.
"Candidates" means individuals registered to take a Test.
"Law" means any statute, regulation, law, binding code of practice, court order, judgement or decree, direction, policy, code or other binding rule.
"Materials" means any and all documents, methodology, documentation, data, studies, reports, manuals, guides, training materials, instructions and other resources, without limitation, made available by ETS Global on the Website.
"Personal Account" means the Registered User's online account allowing the Registered User to purchase Products or Services on this Website.
"Personal Data" means any information relating to an identified or identifiable natural person.
"Privacy Policy" means this privacy policy.
"Product(s)" means the tangible product(s) sold by ETS Global on the Website including but not limited to books, CD's or other training materials.
"Registered User" means any User who has a Personal Account on this Website.
"Service(s)" means the services available on the Website, including but not limited to Test Sessions, online Tests and online Materials.
"Test(s)" means the TOEIC® Listening and Reading, TOEIC® Speaking and Writing, TOEIC® Speaking, TOEFL® ITP, TOEFL® Junior Standard, TOEFL® Junior Comprehensive, TOEIC Bridge™, Test de Fran9ais International (TFI™) and other tests which may be developed by ETS Global in the future and which are offered on this Website.
"Test Session(s)"means the test session(s) organized for the administration of the Tests.
"User" means any visitor of the Website.
"You" or "Your" means the person accessing and using the Website.
"Website"means this website located at www.etsglobal.org.


Article 2 Privacy and security


Educational Testing Service (ETS) Global B.V. ("ETS Global") respects Your privacy. This Privacy Policy governs our collection and use of Your Personal Data on this Website and other ETS Global websites. Personal Data includes information that can identify You as a specific individual, such as Your name or email address. Personal Data does not include aggregate or statistical information.


Article 3 Personal Data we collect



When You visit any page on our Website, we use standard Web server log files to monitor and evaluate our Website's technical capability and performance. We use this information to find out how many people visit our Website, to determine the areas of greatest interest on our Website, and to make improvements to our Website. We also collect and process Personal Data that You provide voluntarily when:

• registering for a Test;
• becoming accredited Test center;
• creating an online Personal Account to become a Registered User;
• applying for a position at ETS Global.
The Personal Data collected via the Website may include, in particular:

Article 4 How we use Your Personal Data?


We use Your Personal Data to:
• Complete any registration, purchases, or other transactions You request online;
• Improve our Website;
• Improve our Products and Services, and identify, develop, and offer Products and Services;
• Personalize Your experience on the Website, and customize the content and/or format of the pages You visit;
• Notify You about updates, Products, Services, and/or special offers from ETS Global, its affiliates, and selected third parties;
• Ask You to participate in brief surveys;
• Generate aggregate statistical studies and conduct research related to our Products and Services and the Use our Website.


Article 5 Disclosure of Your Personal Data

 

We disclose Your Personal Data to certain third parties to provide the Products and Services You have requested online. For example, when You register for a Test, we will provide certain registration information to companies that administer the Tests in Your area. We may also disclose Your Personal Data to third parties that provide administrative or processing services for us, for example, printing, mailing, and payment processing. Our contract with these third parties prohibits them from using information except to provide the Product or Service You requested. If You ask us to, we will disclose Your Test scores to schools and others.
We may also disclose Personal Data collected on the Website, in accordance with Applicable Law, to assert or defend our rights and property, to prevent harm to others, to collect a debt, or in response to legal processes such as subpoenas. Please note that an additional disclosure may be made regarding Test Candidates, further details are specified in the Consumer Terms and Conditions.
Your Personal Data may be disclosed to ETS Global affiliates and/or third parties located outside of the European Union to whom we may entrust the performance of marketing and operational functions, monitoring and recording details of customer needs and preferences, or assistance and advising in operating our business. Any data transfers to recipients located outside of the European Union are secured by appropriate contractual clauses.
 


Article 6 Choices in relation to receiving marketing communications


When You register for a Test online or create a Personal Account, You will have the ability to opt-in to receive certain marketing communications from ETS Global, including voicemail or e-mail. Whether or not You decide to opt-in during the registration, You will always be able to change the option chosen later on, by contacting us at the following email address: serviceclient@etsglobal.org
Please note that, ifwe obtained Your contact details in the course of a sale of a Product or a Service to You, we can send e-mail or call You in order to provide the Product or Service that You requested or in order to offer You Products and/or Services similar to those You have already purchased.
In any case, each our marketing communication shall contain a link enabling You to opt-out of receiving further marketing communications from ETS Global.


Article 7 Third-party Advertisers



In addition, we may use third-party advertisers to serve or track advertisements on other websites. Please note that these third parties also may use cookies, pixel tags and other technologies to, among other things, enable such third parties to record which ads Your browser has loaded and which site pages You may have been viewing when the ads were delivered or accessed. Use of such third-party sites is subject to the terms of use and privacy policies of those third parties. ETS Global does not control the use of this technology or the resulting information and is not responsible for any actions or policies of such third parties.


Article 8 Security

 

ETS Global has established safeguards to help prevent unauthorised access to or misuse of Your Personal Data but cannot guarantee that Your Personal Data will never be disclosed in a manner inconsistent with this Privacy Policy (for example, as a result of unauthorized acts by third parties that violate Applicable Law or relevant Web policies).
If You register for a Personal Account, You will be asked to select a password to help protect Your Personal Data. These passwords help us verify Your identity before granting access or making corrections to any of Your Personal Data. You should never disclose Your password to anyone. ETS Global will never ask You for Your password in an unsolicited phone call or e-mail. You are responsible for maintaining the secrecy of Your passwords and any account information. When You provide credit card information, it is transmitted using SSL technology to help prevent unauthorised access to or misuse of that information.


Article 9 Changes to this Privacy Policy

This website may contain links to other third-party websites. ETS Global does not control the privacy policies or practices oif these third-party sites. You should review those policies before providing any information . ETS Global is not responsible for the content or practices of any linked third-party sites, and we provide these links solely for the convenience and information of our Users. Specifically, if You use a credit card to pay for any Products or Services, ETS Global is not responsible for any information You provide regarding the credit card by linking through to a credit card processor’s website.
 


Article 13 Data Retention
 


Your Personal Data will be retained for as long as required for the purpose described in this Privacy Policy or the Management of the Contract with You for the provision of the Test Services, the defense of legal claims and solving disputes, for Test Security purposes, and if necessary for compliance with statutory obligations.

ETS Global is providing this supplemental privacy notice to give individuals in the European Economic Area (EEA) the additional information required by the EU General Data Protection Regulation. These provisions, together with the statements in the ETS Global Privacy Notice, explain our practices with regard to EEA personal data.

2. The Purposes and Legal Basis for Processing, Including Legitimate Interests

The Privacy Notice explains the reasons why we process your Personal Data. We only process Personal Data when we have a legal basis for the processing, such as:
• To fulfill a contract with you, such as to provide you with an ETS Test or a test offered by another company through ETS Global;
• For closely-related purposes, such as payment processing and financial account management, contract management, website administration, business continuity and disaster recovery, security and fraud prevention, corporate governance, reporting and legal compliance;
• With your consent (or provided you have not objected, as may be applicable), such to provide you with marketing communications or to send your scores to your designated recipients.
We may also process your Personal Data for the purposes of our legitimate interests, provided that such processing shall not outweigh your rights and freedoms. In particular, we may process your Personal Data as needed to:
• Protect you, us or others from threats (such as security threats or test fraud);
• Improve ETS’s Tests and support ETS Research Initiatives;
• Comply with the laws that are applicable to us around the world;
• Enable or administer our business, such as for quality control, consolidated reporting and customer service;
• Manage corporate transactions, such as mergers or acquisitions;
• Understand and improve our business, improve test integrity and for research purposes.

3. Automated Decision Making and Profiling

ETS Global may use automated processes in connection with scoring tests and for similar purposes, as needed to provide the test services that you have requested. All such decisions are subject to human review. We will not make automated decisions about you that may significantly affect you, unless (1) the decision is necessary as part of a contract that we have with you, (2) we have your explicit consent, or (3) we are required by law to use the technology. You can learn more about Test scoring by reading the information posted on our Website about each of our tests.
In some cases, we use certain elements of personal data for ETS Research. For example, we may consider how certain types of test takers (such as non-native English speakers) respond to specific test questions. Our research initiatives reflect our commitment to fairness and equity in testing, helping to ensure that are our tests are accessible and free from bias. They also seek to improve teaching, learning and assessment. Our research results do not contain any identifiable data and are not used to target or profile individuals.

4. When You are Required to Provide Personal Data to ETS Global

In most cases, you are not required by law to provide any Personal Data to ETS Global. You are required to provide certain Personal Data to enable us to enter into a contract with you so that you can use our products and services. Our registration forms indicate which data elements are required for our contracts. If you do not provide these data elements, we cannot do business with you. If you request an accommodation from ETS Global, such as special testing conditions needed because of a health condition or disability, you may be required to submit additional personal data (including special categories of data) as needed for us to evaluate and respond to your request.

5. Your Rights

As stated in the Privacy Notice, you always have the right to object to our marketing communications. To opt out of emails, simply click the link
labeled “unsubscribe” at the bottom of any email we send you. To revoke permissions that you may have given to send text messages, text STOP in response to any message.
ETS Global also respects the rights of EEA residents to access, correct and request erasure or restriction of their Personal Data as required by law. This means:
• You generally have a right to know whether or not ETS Global maintains your Personal Data. If we do have your Personal Data, we will provide you with a copy (subject to the rights of others). If your information is incorrect or incomplete, you have the right to ask us to update it.
• You have the right to object to our processing of your Personal Data.
• You may also ask us to delete or restrict your Personal Data.

Please understand that we may need to verify your identify before we can process your request. Additionally, our ability to delete Personal Data will be limited in those cases where we are required to retain records, such as in connection with score reports and test security processes. If you believe that we have processed your Personal Data in violation of applicable law, you may file a complaint with the ETS Global Office of Legal Counsel or with a supervisory authority.

6. International Transfers

As stated in the Privacy Notice, your Personal Data may be transferred to, stored at or processed in the European Union and other countries which may not have equivalent privacy or data protection laws. We generally use approved Standard Contractual Clauses to assure that Personal Data is adequately protected when it is transferred out of the EEA or Switzerland, but we may also make transfers to recipients with approved Binding Corporate Rules or to recipients in the United States who have certified to the EU-U.S. and/or Swiss-U.S. Privacy Shield Framework.

7. Data Retention

We will retain your Personal Data for as long as the information is needed for the purposes set forth above and for any additional period that may be required or permitted by law. Unless we are required by law or have a legitimate interest to retain your information, we will delete it within 30 days of your request.
